    Six attorneys from the Dallas office of Cowles & Thompson have earned spots on the 2008 Texas Super Lawyers list, as determined by a statewide survey published in the October issue of Texas Monthly magazine. Additionally, Mr. Cowles is highlighted as one of the Top 100 attorneys in Texas, a designation he has earned each year since the list started in 2003. To compile the Super Lawyers list, more than 70,000 attorneys from across the state were asked to nominate the top lawyers in Texas.  A blue-ribbon panel of attorneys chosen by Super Lawyers editors assisted in the final selections, and fewer than 5 percent of Texas attorneys were named to the list.

  • Jim Chester - speech on "Export Controls and Technology" 9/22/08 12:00 Belo Mansion

    Jim Chester will be present, "Export Controls and Technology" at the monthly meeting of the Computer Law Section of the Dallas Bar Association at noon on Monday, September 22, 2008 at the Belo Mansion in Dallas.     Nations have always been concerned about powerful technologies falling into the hands of their enemies, and post-9/11 America is no exception.  However, by its very nature, technology is often mercurial and difficult to control.  This has led American export regulators to implement a variety of increasingly broad and creative measures to control the export of sensitive US-origin technology to foreigners.  Maximum penalties and enforcement activities are increasing, as are the number of pitfalls that await uninformed exporters of US technology.  Jim's presentation will discuss  key export control rules, with a special emphasis on those implicated by exports of technology.    Admission is free, as is CLE credit for members of the Dallas Bar Association.  Lunch is available at a cost.   Jim is a shareholder at Cowles & Thompson, PC, and servers as Chair of the firm's International Business & Trade Practice Group and the Intellectual Property Practice Group.

  • Good Results for Our Clients -- Judgment in Fraud Case
    August 2007

    Carrie Phaneuf and Tori Regas represented three former officers of a Plano homeowners' association against claims asserted by a homeowner for fraud and breach of fiduciary duty.  The officers alleged counterclaims against the homeowner plaintiff for filing a frivolous lawsuit and for defamation, based on materials the plaintiff distributed to other homeowners, as well as on the Internet.  The plaintiff failed to appear for trial.  The court subsequently dismissed plaintiff's claims and entered judgment in favor of the officers on the counterclaims, awarding general damages and attorney fees.

    Cowles & Thompson attorney Kate Pigg has been named to the 2007 Leadership Class of the Dallas Association of Young Lawyers.  The DAYL provides leadership training to a select group of young lawyers each year, and class members participate in professional development programs, community service products, and meetings with other bar leaders, in an effort to prepare them for positions of future bar leadership. Kate represents clients in commercial litigation and professional liability matters.  Admitted to practice in the State of Texas, she is also admitted before the U.S. District Court for the Northern District of Texas.  She received her B.A. degree in English from Texas A&M University, and her J.D.   • Good Results for Our Clients -- Resolution of $27 Million Partnership Dispute
    June 2007

    In June 2007, Richard Barrett-Cuetara, Melissa J. Pegram and Sim Israeloff successfully resolved a $27 million partnership dispute involving the control, management, and transfer of ownership interests in six hotels branded by three international hotel companies. The complex dispute among fourteen entities and five individuals resulted in the filing of a State District Court lawsuit in Texas, setting aside two settlement agreements entered into during the pendency of the state court litigation, the filing of a Private Arbitration proceeding, and the enforcement of the terms of a third settlement agreement entered into by the parties. In the course of handling this matter, Rick, Melissa and Sim were aided by Dolores Wolfe, Greg Lensing and Michael Northrup in pre-arbitration preparation, legal research and briefing. Richard Barrett-Cuetara's practice areas include Hospitality & Lodging, Commercial Litigation and Real Estate/Real Estate Finance. Melissa J.   • Good Results for Our Clients -- Summary Judgment in Employment Law Case
    May 2007

    Greg Carboy and David Johnson obtained summary judgment in federal district court on three separate employment claims filed against a client of the firm.  The case involved two sets of plaintiffs:  two former female employees and a former independent contractor of the defendant company.  Both sets of plaintiffs filed claims of race discrimination, retaliation and hostile work environment based upon separate incidents.  The court held that the claims brought by the two former employees failed to produce enough evidence to negate the defendant's legitimate, nondiscriminatory reasons for the termination of their employment.  The court further held that the defendant submitted sufficient evidence, as a matter of law, that the plaintiff was an independent contractor, not an employee of the defendant, and thus not entitled to the protections afforded to employees under Title VII of the Civil Rights Act of 1964.  The court granted both summary judgment motions in their entirety, dismissing all claims made against the firm's client.

    April 2007

    Richard Barrett-Cuetara and Dolores Wolfe successfully pursued claims against a co-owner in a dry cleaning business for breach of his fiduciary duty, breach of contract, mismanagement, and derivative claims, resulting in the firm's client obtaining 100% ownership of the corporation and its assets, which are valued in excess of $2.4 million.  Melissa Pegram, a shareholder in the firm's Corporate and Business practice group, handled the transactional issues presented in this matter, preparing all documentation necessary for severance of the business relationship of the parties, the transfer of the individual business interests, and transfer of all related assets.

  • C&T Lawyers Finalize $60 Million Hotel Acquisition
    April 2007

    On April 9, 2007, members of the Firm's Lodging & Hospitality and Real Estate practice groups closed a $60,000,000 acquisition of four mid-tiered hotels located in Texas.  The hotels will be converted to "select-service" hotels and franchised with an international hotel company.  The Firm handled the purchase and sale agreements, land use and ancillary rights, review of title commitments and surveys, and closed the transaction with the client's equity partner and lender.  Richard Barrett-Cuetara, William L. Siegel, John M. Hill, and Melissa J. Pegram represented their hotel client in this acquisition.  Rick Barrett also received the first "GCL" (Great Commercial Lawyer) designation from Jim Cowles, based on the firm's traditional Great Trial Lawyer recognition.

    Mark Cronenwett and David Johnson won summary judgment for their client, a loan servicer. The ex-wife of the loan servicer's borrower alleged that the security instrument on the subject property was unenforceable because the ex-wife had obtained a prior lien interest on the subject property in a divorce decree. Mark and David obtained summary judgment, and an award of attorneys fees on their counterclaim, because the ex-wife had failed to abstract the divorce decree and file the abstract in the countys real property records before the bank's loan was executed.

    In January 2007 Carrie Phaneuf obtained summary judgment for her client, a national restaurant chain.  The plaintiff had alleged injuries from a slip and fall accident , but failed to answer discovery requests.  The Court dismissed the lawsuit on that basis.
