Jonathan Spigel recently recovered a mid-six-figure settlement for a trucking company and two insurance carrier clients who sought property damage and workers’ compensation benefits-related damages in a wrongful death case. The client trucking company’s driver was operating a gasoline tanker trailer (filled almost to its 9,200-gallon capacity) on a US highway that was under construction. A pickup truck driver ran a stop sign and collided with the tanker. There was also an uncovered one-way sign in what had become a temporary two-way construction zone. Defendants sued included the Texas Department of Transportation, its general contractor, and a highway signage subcontractor.
