  • Jim Chester speaks to International Section of Texas Bar Association's CLE program
    June 2009

    Jim Chester spoke to the International Section of the Texas Bar Association’s CLE program on Thursday, June 25, 2009.  The CLE was part of the Texas Bar Association’s annual meeting in Dallas.  His topic was “Protecting Intellectual Property in International Trade.”  The presentation discussed how to identify different types of IP, including trademarks, copyrights, trade secrets, and patents.  The presentation also discussed ways to protect and enforce IP rights in the US, abroad, and at the US border.

  • Probate law site debuts
    June 2009

    As announced by Chad Eric Watt in the Dallas Business Journal, Cowles & Thompson has launched a new website focused on probate law. Probate law has been a focus of the firm for years, but the website has been launched at a time of a major generational wealth transfer, notes partner Steve Spitzer. "There's a silver tsunami of all the aging baby boomers passing away and passing on assets," he said.  "And when there's money involved, there's disputes involved." The site, www.TexasEstateDisputes.com, offers comments from attorneys on wills and trusts, inheritance and estate issues.  Too often, people with assets leave behind a legacy without proper planning, and that leads to disputes, said Spitzer, head of Cowles & Thompson's Tyler office.

  • Successful Resolution of $2 Million Investment Fraud Case
    May 2009

    In April 2009, Richard Barrett-Cuetara, Eric Yepez  and Melissa J. Pegram successfully resolved a $2 Million investment fraud case on behalf of their clients. The Firm's clients were investors,  officers, shareholders and members of the board of directors of the defrauded corporation.  The lawsuit alleged the President of the defrauded corporation had misappropriated corporate funds, breached his fiduciary duties, participated in “self-dealing”, and conspired with a national banking institution to usurp all ownership rights in the defrauded corporation in a “quid pro quo” arrangement of favorable loans to the President of the defrauded corporation in exchange for alleged bribery payments to the national banking institution.  In a favorable settlement, the Firm's clients received the return of more than $1.5 Million dollars, representing approximately 75% of their initial investment of $2 Million dollars.  Mr. Barrett-Cuetara and Mr. Yepez prosecuted the litigation, while Ms. Pegram, Chair of the Firm’s Corporate and Business Law Section, analyzed various documents and transactions that were a part of this arrangement and also prepared the settlement documents, including the Settlement Agreement, the Promissory Note, a Pledge Agreement, utilizing stock in several corporations as security for payment of settlement obligations, corporate resolutions and consents, and Deeds of Trust to secure performance of obligations under the terms of the settlement documents.

  • Great Results for our Client - A Six Figure Jury Verdict Obtained and an Award of Attorneys' Fees and Costs.
    April 2009

    On March 27, 2009, the Firm obtained a six figure jury verdict and an award of attorneys’ fees and costs on behalf of its client. The litigation involved enforcement of two post-separation agreements (Separation, Release and Restructuring Agreement and Contribution and Indemnification Agreement) that related to the division of commercial shopping centers, the transfer of general partner interests, and liability of the managing general partner for committing “Bad Boy Guarantor” acts under the Indemnification Agreement.  The Defendant was found liable for not indemnifying and reimbursing the Plaintiff for payment of ad valorem taxes to the lender. Richard Barrett Cuetara, Steven Moses, and Mark Hill tried the case to the jury.  Byron Henry of the Firm’s Appellate Practice Group assisted with the jury charge and related motion practice.

    Jim Chester will be present, "Export Controls and Technology" at the monthly meeting of the Computer Law Section of the Dallas Bar Association at noon on Monday, September 22, 2008 at the Belo Mansion in Dallas.     Nations have always been concerned about powerful technologies falling into the hands of their enemies, and post-9/11 America is no exception.  However, by its very nature, technology is often mercurial and difficult to control.  This has led American export regulators to implement a variety of increasingly broad and creative measures to control the export of sensitive US-origin technology to foreigners.  Maximum penalties and enforcement activities are increasing, as are the number of pitfalls that await uninformed exporters of US technology.  Jim's presentation will discuss  key export control rules, with a special emphasis on those implicated by exports of technology.    Admission is free, as is CLE credit for members of the Dallas Bar Association.  Lunch is available at a cost.   Jim is a shareholder at Cowles & Thompson, PC, and servers as Chair of the firm's International Business & Trade Practice Group and the Intellectual Property Practice Group.

For more than a decade, Jim has advised Fortune 500 companies, start-ups, and mid-sized companies in a variety of industries regarding business formation and transactions, intellectual property protection & licensing, and international business & trade legal matters. He routinely represents companies before the US Patent and Trademark Office (USPTO), the US Library of Congress (Copyright Office), US Customs & Border Protection, US Department of Commerce, US Department of Defense Trade Controls, the Office of Foreign Asset Controls, the US International Trade Administration, and other federal and international governing bodies and agencies.  In addition to his work at the Firm, Jim is also an adjunct professor of law at Baylor University Law School, where he teaches courses on International Trade Law and International Business Transactions. He also served for several years as an adjunct professor at the University of Dallas College of Business, teaching the Legal Environment of Business.

    Cowles & Thompson is proud to welcome Eric Yepez as a new associate in its Dallas office.  Eric is a 2007 graduate of Texas Wesleyan University School of Law, and recently passed the July 2007 Texas Bar Exam. Eric's practice is concentrated in medical malpractice, premises liability, commercial litigation, transportation & trucking litigation, and employer-employee relations.     Cowles & Thompson attorneys Tim Ammons and David Oliveros participated with over 40 children in the Youth Conflict Resolution Center's annual mock trial, with this year's trial featuring the case of Little Red Riding Hood v.   • Good Results for Our Clients -- Judgment in Fraud Case
    August 2007

    Carrie Phaneuf and Tori Regas represented three former officers of a Plano homeowners' association against claims asserted by a homeowner for fraud and breach of fiduciary duty.  The officers alleged counterclaims against the homeowner plaintiff for filing a frivolous lawsuit and for defamation, based on materials the plaintiff distributed to other homeowners, as well as on the Internet.  The plaintiff failed to appear for trial.  The court subsequently dismissed plaintiff's claims and entered judgment in favor of the officers on the counterclaims, awarding general damages and attorney fees.

  • C&T Lawyer Named to 2007 Leadership Class

    Cowles & Thompson attorney Kate Pigg has been named to the 2007 Leadership Class of the Dallas Association of Young Lawyers.  The DAYL provides leadership training to a select group of young lawyers each year, and class members participate in professional development programs, community service products, and meetings with other bar leaders, in an effort to prepare them for positions of future bar leadership. Kate represents clients in commercial litigation and professional liability matters.  Admitted to practice in the State of Texas, she is also admitted before the U.S. District Court for the Northern District of Texas.  She received her B.A. degree in English from Texas A&M University, and her J.D.
