Lindsay Stansberry and Ken Mighell successfully appealed the conviction of a criminal defendant in federal court, on the basis that the trial court improperly allowed the government to present evidence at the sentencing hearing in violation of the Fifth Circuit's first remand, that tended to prove facts not found by the jury during trial. The Fifth Circuit reversed and remanded the case to the trial court for re-sentencing.
