
Mike Northrup wins appeal of summary judgment order

Mike Northrup secured the dismissal of an appeal from a summary judgment order in an appeal of an action to quiet title and for alleged violation of the fair debt collections practices act. A property owner filed suit attempting to cancel a mortgage debt on which she had defaulted many years prior. The trial court initially struck the plaintiff’s pleadings for failure to state a claim and ordered her to replead. After the plaintiff filed amended pleadings, the mortgage company obtained summary judgment as to the amended pleadings, and the property owner appealed. The property owner appealed. While the appeal was pending, the mortgage company foreclosed on the property. The El Paso Court of Appeals granted the mortgage company’s motion to dismiss the appeal as moot.
