Dallas, TX (May 9, 2023) – Cowles Thompson recently achieved a dismissal and concluded a 20-year long class action case – where our client ultimately paid nothing. The suit was the longest-running case in the firm’s history.

The class action was filed in October 2003 against our national retailer client and others. The plaintiffs claimed that the retailers had improperly charged sales tax on certain exempt products. The defendants filed Pleas to the Jurisdiction, noting that all sales taxes are remitted to the state and plaintiffs have the ability to seek refunds from the state. The motion was heard in April 2004, but not ruled on for the next 19 years, effectively blocking plaintiffs from any recovery. Plaintiffs took no steps to force the court to rule or otherwise pursue their case. At a hearing on April 26,2023, the judge agreed to dismiss the case for want of prosecution.
